1. Agreement

By using ClockClanker ("the App"), you agree to these Terms. If you disagree, do not use the App.

2. Eligibility

You must be at least 16 years old to use the App.

3. Service Description

ClockClanker is an AI-powered alarm clock that engages you in conversation to help you wake up. It is provided for personal, non-commercial use only.

4. Subscriptions and Payments

4.1 Subscription Required

The App requires an active subscription to access its features.

4.2 Subscription Terms

• Subscriptions are billed through Apple's App Store
• Payment is charged to your Apple ID account at confirmation of purchase
• Subscriptions automatically renew unless auto-renewal is turned off at least 24 hours before the end of the current period
• Your account will be charged for renewal within 24 hours prior to the end of the current period at the subscription rate
• You can manage and cancel your subscription in your Apple ID Account Settings at any time
• Cancellation takes effect at the end of the current billing period — you retain access until then
• No refunds are provided for partial subscription periods

4.3 Cancellation

You can cancel your subscription at any time through your Apple ID Account Settings (Settings → [Your Name] → Subscriptions). When you cancel:

• You will retain access until the end of your current billing period
• Your subscription will not renew after that period ends
• No refunds are given for unused time in the current period

4.4 Refunds

All payments are processed by Apple. Refund requests must be submitted through Apple (reportaproblem.apple.com). We cannot issue refunds directly.

4.5 Price Changes

We may change subscription prices. Price changes take effect at the start of the next subscription period. Continued use after price changes constitutes acceptance of the new price.

5. Account

You must sign in with Apple to use the App. You are responsible for all activity under your account. Do not share your account or allow others to access it.

6. Acceptable Use

You agree NOT to:

• Use the App unlawfully
• Attempt unauthorized access to the App or its systems
• Reverse engineer, decompile, or disassemble the App
• Use automated tools to extract data
• Abuse the AI system or send excessive requests
• Create multiple accounts to circumvent limits
• Share your account with others

7. Usage Limits

The App includes daily conversation limits, session duration limits, and rate limiting. Accounts that abuse these limits may be suspended or terminated.

8. Intellectual Property

The App and its content are owned by BlackIgel or its licensors. You receive a limited, non-exclusive, non-transferable, revocable license for personal use.

10. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

BLACKIGEL SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Any loss of profits, data, or opportunities
• Any damages from missed alarms or failure to wake up
• Any damages from inability to use the App
• Any damages from unauthorized account access

TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID IN THE 12 MONTHS BEFORE THE CLAIM, OR €50, WHICHEVER IS GREATER.

Some jurisdictions do not allow these limitations. If so, limitations apply to the maximum extent permitted.

11. Indemnification

You agree to indemnify and hold harmless BlackIgel from claims arising from your use of the App, violation of these Terms, or violation of any rights.

12. Termination

By You: Stop using the App anytime. Delete your account via Settings → Delete Account.

By Us: We may suspend or terminate your access for violation of these Terms, abuse, non-payment, fraud, or legal requirements, with or without notice.

Upon termination, your right to use the App ceases immediately.

13. Changes to Terms

We may modify these Terms. Material changes will be communicated through the App. Continued use after changes constitutes acceptance.

14. Governing Law

These Terms are governed by German law. Disputes shall be resolved in Berlin courts, except where consumer protection laws provide otherwise.

15. Severability

If any provision is unenforceable, it will be modified to the minimum extent necessary. Other provisions remain in effect.

16. Entire Agreement

These Terms and our Privacy Policy constitute the entire agreement between you and BlackIgel regarding the App.
